Basket Revolution Gifts Ltd. ("Basket Revolution," "we," "us," or "our") is responsible for the personal information under its control. This Policy explains how we handle information when you visit basketrevolution.com, place or receive an order, subscribe, contact us, or otherwise interact with our business.

We handle personal information in accordance with applicable Canadian privacy laws, including British Columbia's Personal Information Protection Act (PIPA) and the federal Personal Information Protection and Electronic Documents Act (PIPEDA), where applicable.

1. Personal Information We Collect

The information we collect depends on how you interact with us and may include:

  • Customer and purchaser information: name, email, telephone number, billing and delivery addresses, account details, order history, communications, and customer-service records.

  • Recipient and delivery information: recipient name, address, telephone number, buzzer or concierge details, delivery instructions, requested delivery date, and information needed to complete or confirm delivery.

  • Gift and order details: greeting-card messages, product selections, customizations, dietary or product preferences, special requests, and other information you choose to provide.

  • Corporate and volume-order information: company name, business contact details, billing information, purchase instructions, and recipient information supplied through an order form or multiple-address spreadsheet.

  • Payment and transaction information: payment method, transaction status, billing details, refunds, and fraud-prevention information. Payments are processed by Shopify and/or the payment provider offered at checkout. We do not normally receive or store your complete payment-card number or security code.

  • Alcohol-delivery information: where required, we or the delivery provider may verify that the purchaser or recipient meets the applicable legal-age and identification requirements. We do not normally retain a copy of the recipient's identification.

  • Website and device information: IP address, browser, device and operating system, approximate location, referring source, pages and products viewed, and cart, checkout, advertising, and email interactions.

  • Marketing preferences: whether you have subscribed to or unsubscribed from promotional emails.

Please do not include unnecessary sensitive personal information in greeting messages, delivery instructions, or other free-text fields.

2. How We Collect Information

We collect personal information:

  • directly from you when you place an order, create an account, subscribe, complete a form, send a corporate recipient list, or contact us;

  • from the purchaser or corporate client when an order is sent to another person;

  • from a recipient when we communicate about delivery;

  • automatically through cookies, pixels, analytics tools, and similar technologies; and

  • from providers involved in payment, website operation, shipping, delivery, or support.

If you provide information about another person, you confirm that you are authorized to provide it for preparing and delivering the gift. Please provide only what is reasonably necessary.

3. How We Use Personal Information

We may use personal information to:

  • review, verify, accept, prepare, customize, deliver, modify, cancel, refund, or administer an order;

  • communicate about an order, delivery, question, or service request;

  • process payments and protect against errors, fraud, abuse, and security threats;

  • confirm delivery and comply with legal requirements, including age-verification requirements for alcohol;

  • maintain customer, transaction, accounting, tax, and business records;

  • operate, secure, analyze, and improve our website, advertising, and services;

  • send promotional emails when you have chosen to subscribe;

  • establish, exercise, or defend legal claims and enforce our policies; and

  • comply with applicable laws, court orders, regulatory requirements, and lawful requests.

We will not use information for a materially different purpose without additional consent where required.

4. Consent and Recipient Information

By voluntarily providing personal information, you consent to its collection, use, and disclosure for the purposes described in this Policy and otherwise identified at the time of collection. In some circumstances, consent may be implied from your actions, such as providing a recipient's address so that we can deliver the gift.

You may withdraw consent, subject to legal or contractual restrictions and reasonable notice. Withdrawing consent may prevent us from completing an order or providing a requested service. Consent for promotional emails can be withdrawn at any time without affecting order-related communications.

We use recipient information only for purposes connected with the gift, including preparation, delivery, customer service, safety, and records. A recipient is not added to our promotional list unless that person separately subscribes or otherwise consents.

5. When We Share Personal Information

We disclose only what is reasonably required. Depending on the transaction, information may be shared with:

  • Shopify, which provides our ecommerce platform, hosting, checkout, customer records, and native email-subscription functions;

  • payment processors, banks, and fraud-prevention providers used to authorize and complete transactions;

  • product-option and customization providers, including Infinite Options/ShopPad, which support fields such as gift messages, custom selections, and requested delivery dates;

  • shipping and delivery providers, including shipping-management platforms, local delivery providers, and carriers such as Canada Post, FedEx, UPS, Purolator, or Canpar;

  • communications providers, including email, telephone, text, and WhatsApp when you choose those services;

  • analytics and advertising providers, including Google Analytics, Google Ads, and Meta/Facebook;

  • professional, administrative, and technical service providers, such as accountants, legal advisers, and authorized IT support; and

  • government authorities, regulators, courts, insurers, or other parties when required or permitted by law, or when reasonably necessary to protect our business, customers, recipients, or legal rights.

Information may also be transferred in a sale, financing, reorganization, merger, or transfer of the business, subject to confidentiality and legal requirements.

We do not sell or rent personal information for money. Certain advertising or analytics disclosures may be treated as "sharing" under some privacy laws even when no money is exchanged.

6. Shopify and Processing Outside Your Province or Country

Our store is hosted by Shopify. Shopify processes personal information to provide the store, checkout, security, analytics, and related services. You can learn more in the Shopify Consumer Privacy Policy.

Information may be stored or processed in Canada, the United States, or other jurisdictions where we or our authorized providers operate. It may be subject to local laws and lawful government access. We remain responsible for information under our control and use reasonable measures to require providers to protect it.

7. Cookies, Analytics, and Advertising

Our website and providers use cookies, pixels, tags, and similar technologies to operate the store and checkout, remember selections, protect against fraud, understand website performance, and measure or personalize advertising.

These technologies may be provided by Shopify, Google, and Meta/Facebook and may collect device identifiers, IP address, browsing activity, cart events, and purchase or conversion information. Google and Meta process information under their own privacy policies.

You can control cookies through your browser and, where available, through the cookie-preference tools displayed on our website. Blocking essential cookies may prevent parts of the store or checkout from working correctly. You can also manage advertising preferences through your Google and Meta account settings.

8. Email Marketing

When you subscribe through our website or otherwise provide valid consent, your email address is recorded in Shopify as an email subscriber. We may send occasional gift ideas, seasonal updates, and promotional offers. Every promotional email will provide an unsubscribe method, and you may also contact us to withdraw your consent.

Unsubscribing from marketing does not prevent us from sending transactional or service communications relating to an order, payment, delivery, security issue, or request you initiated.

9. Retention

We retain information only as long as reasonably necessary for the purposes described here and for legal, accounting, tax, dispute, fraud-prevention, and business-record requirements.

Recipient details and corporate spreadsheets are used for order preparation, coordination, delivery, and records. Working copies are securely disposed of when no longer reasonably required. Some information may remain in Shopify, payment, accounting, delivery, or backup records for the applicable retention period. We then take reasonable steps to delete, anonymize, or securely dispose of it.

10. Security

We use reasonable safeguards appropriate to the sensitivity of the information, including access restrictions, account security, reputable providers, platform controls, confidentiality obligations, and handling procedures.

No website, transmission method, or storage system is completely secure. If a privacy or security incident occurs, we will investigate and provide any notices required by applicable law.

11. Your Privacy Rights

Subject to applicable law and limited exceptions, you may request:

  • access to personal information we hold about you;

  • information about how it has been used or disclosed;

  • correction of inaccurate or incomplete information;

  • withdrawal of consent for future optional uses;

  • removal from promotional communications; or

  • deletion of information that we are not legally or reasonably required to retain.

We may need to verify your identity before completing a request. We may also decline or limit a request where permitted or required by law, including where disclosure would reveal another person's information or where records must be retained for legal, tax, fraud-prevention, transaction, or dispute purposes.

12. Minors, Changes, and Contact

Our services are intended for adults able to enter into a purchase transaction. We do not knowingly request personal information directly from children. Alcohol products may be purchased and delivered only in accordance with applicable legal-age requirements.

We may update this Privacy Policy when our services, technology, providers, or legal obligations change. The current version will be posted on our website with a revised "Last updated" date. Where appropriate or required, we will provide additional notice of material changes.
